“This court will have to be making decisions about seating jurors for that trial, a trial that we don’t know what the charges will be in yet because of the pendency of the appeal. And maybe we should start with actually the motion. Originally, you know, the state had brought this motion to reinstate the third-degree murder charge, allow the third-degree murder charge back in as one of the charges in the case, as it had been originally. So this court would be making decisions about jurors for a trial about which we don’t know what the exact charges are going to be. And that jeopardy you know, once it attaches, would — that clearly cannot happen because that would prevent the state from retrying the defendant, trying on new charges. That’s why it’s necessarily involved.” “Just looking at the clock, we have jurors, but I think realistically, we’re not going to get to any jury selection. And we won’t have an answer until at least tomorrow. So unless any of the parties object, I’m going to kick our jurors loose.”
